Yes. Once a case is referred to mediation, all parties (and their attorneys if represented) must participate or choose another court-approved form of dispute resolution.


Sessions vary depending on complexity—some finish in a few hours, while others might take a full day or multiple sessions.


You may select any NCDRC-certified mediator by agreement of the parties or ask the court to appoint one.


Then the case continues to trial, with nothing revealed to the judge or jury about why mediation didn’t result in a settlement. 


Fees vary depending on the mediator. Court-appointed mediators have standard rates, but if you and the other side agree on a private mediator, you can set a rate by agreement. o this item.
